1. Accepting these terms
These terms are an agreement between you and Forgeter, Inc. ("Forgeter", "we", "us"). They cover the Forgeter app, forgeterai.com and related services. By creating an account or using Forgeter, you agree to these terms and to our Privacy Policy. If you don't agree, don't use Forgeter.
2. Who can use Forgeter
You must be at least 13 years old, or older if your country requires it, and able to form a binding contract. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you. You can't use Forgeter if we have previously banned you or if the law prohibits it.
3. Your account
- You sign in with a phone number you own, verified by a 6-digit text code, or with LinkedIn.
- Keep your phone and codes secure. You are responsible for what happens on your account.
- Give accurate information and keep it up to date. If you change your number, update it in Settings.
- Tell us right away if you think someone else is using your account.
4. Your content
You own the messages, photos, voice notes, documents and other content you create on Forgeter. To run the service, you give us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit and display your content. This license is only for operating, improving and protecting Forgeter, including its AI features, and it ends when you delete the content or your account, except where others already have a copy or we must keep it by law.
You are responsible for your content and must have the right to share it. When you share content with others, they may save or forward it.
5. The AI assistant
- Forgeter uses AI to suggest plans, dates and to-dos from your chats, answer questions, summarize your feed and help with tasks.
- AI can be wrong or incomplete. Check suggestions, times and answers before you rely on them.
- Reminders can be delayed or missed, for example if your phone is off, offline or has location or notifications turned off. Don't rely on Forgeter for anything where a missed reminder could cause harm, such as medication, medical care or safety.
- Forgeter is not an emergency service. It can't contact emergency services for you. In an emergency, call your local emergency number.
6. Messages and calls Forgeter makes for you
Forgeter can send scheduled messages and place AI calls when you ask it to. It asks you before it acts. When you approve an action:
- You are responsible for that message or call as if you sent or made it yourself.
- Only ask Forgeter to call people and businesses you have a legitimate reason to contact, like booking a table or checking opening hours.
- Forgeter introduces itself as an AI assistant on every AI call. If you turn on recording, it tells the other person the call is recorded. You must not ask Forgeter to hide that it is an AI or to pretend to be you or anyone else.
- You must follow the laws that apply to you, including laws about call recording, consent, telemarketing and automated calls.
- AI calls are limited by your plan: 3 a month on Free and 30 a month on Plus. We may limit or block calls to protect people from spam and abuse.
7. Location features
Place reminders and live location sharing need access to your location. Only share your location with people you trust, and stop sharing when you no longer want them to see where you are. Live location sharing ends when the time you chose runs out or when you stop it.
8. Acceptable use
Don't use Forgeter to:
- Harass, threaten, bully, stalk or impersonate anyone.
- Send spam, bulk or unsolicited messages or calls, or run robocall campaigns.
- Share content that is illegal, sexually exploits minors, promotes violence, or infringes someone else's rights.
- Track or share someone's location without their permission.
- Record or call people in ways that break the law.
- Scam, defraud or mislead people.
- Collect other people's information without permission, or use bots or scrapers on Forgeter.
- Hack, overload, reverse engineer or get around the security or limits of Forgeter, except where the law allows it.
- Resell or misuse Forgeter or its AI features.
You can report posts, ads and messages in the app. We may remove content or restrict accounts that break these rules.
9. Forgeter Plus and payments
- Forgeter is free to use. Forgeter Plus is an optional subscription, currently $4.99 a month or $39.99 a year, that removes ads and adds unlimited place reminders, 30 AI calls a month, a Plus badge and early features.
- Plus is sold through the Apple App Store or Google Play. Their terms apply to payment, billing and refunds, and we never see your card.
- Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Cancel in your App Store or Google Play subscription settings.
- New subscribers may get a 7-day free trial. Unless you cancel before the trial ends, it turns into a paid subscription.
- If we change the price, we will tell you in advance, and you can cancel before the new price applies.
- Features and limits may change over time. Unused AI calls don't roll over to the next month.
10. Ads and third-party content
The free plan shows ads labeled "Sponsored". Your feed can include posts and links from businesses, news sources and RSS feeds you add. We don't control third-party content, websites or services, and we aren't responsible for them. Your use of them is subject to their own terms.
11. Our app and your feedback
Forgeter, including its name, logo, design and software, belongs to us and our licensors. These terms give you a personal, non-transferable right to use Forgeter as intended. If you send us ideas or feedback, we may use them without owing you anything.
12. Suspension and ending your account
You can stop using Forgeter and delete your account at any time in Settings. We may suspend or end your access if you break these terms, if the law requires it, or to protect people or Forgeter. When possible, we will tell you why and give you a chance to respond. Sections 4, 11 and 13 to 16 continue to apply after your account ends.
13. Disclaimers
Forgeter is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that Forgeter will always be available or error-free, or that AI suggestions, reminders or call results will be accurate or on time.
14. Limitation of liability
To the fullest extent the law allows, Forgeter will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of Forgeter. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or $100. Some places don't allow these limits, so they may not apply to you.
15. Indemnity
If someone brings a claim against us because of your content, your use of Forgeter, or calls and messages you asked Forgeter to make, you agree to cover our reasonable costs and losses from that claim, to the extent the law allows.
16. Disputes and governing law
Please contact us first. Most problems can be solved quickly by email. These terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Ocean County, New Jersey, unless the law where you live gives you the right to bring it elsewhere.
17. Changes to these terms
We may update these terms as Forgeter changes. If the changes are significant, we will tell you in the app before they take effect. If you keep using Forgeter after that, you accept the new terms.
